Top Ten Ongoing Consumer Law Violations
The National Consumer Law Center has listed the following “Top Ten” Consumer Law Violations:
- 1. Bogus affidavits, Robo-signed affidavits used in foreclosure and credit card collection lawsuits;
- 2. Entities foreclosing on mortgages lack standing or do not comply with HAMP mortgage modification requirements;
- 3. Employers pull consumer reports but do not send required notices;
- 4. Voicemail not revealing the caller is a debt collector;
- 5. subprime loans that are unaffordable, fail to include an escrow account, or contain prepayment penalties;
- 6. Document fees, window etching, GAP, or other overpriced auto add-ons are slipped in without permission or through deception;
- 7. TILA requires mortgage servicers to properly credit payments and provide a requested payoff statement and the mortgage holder’s identity; mortgage brokers can no longer encourage appraisers to misrepresent home values;
- 8. Debt buyers and debt collectors bringing lawsuits outside the statute of limitiations (expired claims);
- 9. auto lenders fail to follow state law regarding repossession rules;
- 10. undisclosed prior wreck car sales.
