Consumer ZIP Codes Are Protected: Retailers Can’t Ask You To Tell Them Your ZIP

Merchants can’t ask you for your ZIP code or any other identifying information that they then record when you are using credit cards for purchase. The Song Beverly Credit Card Act of 1971 prohibits retailers from requesting and recording customer’s “personal identification information” during a transaction, and imposes statutory damages of up to $1,000 per violation. ZIP Codes are used by merchants in combination with other information to track you down and market to you. Target, Old Navy, Macy’s, Tiffany’s, and numerous other businesses have Complaints against them seeking to enforce the Song-Beverly Act and protect consumer privacy. If you have turned over your ZIP code, phone number, address, or other identification information, or been requested to do so, your rights may have been violated.
