New AmeriCredit Repo Class Action Launched

AmeriCredit is reporting thousands of California consumers to the Credit Bureaus (Experian, Trans Union, etc) for “deficiency” amounts on repossessed family cars. There’s just one problem: this money may not be owed! The Hanson Law Firm has filed a new case in federal court alleging that AmeriCredit is forcing consumers to either pay a debt they never owed or face having their credit ruined.

This virtual “debtor’s prison” of a large unpaid AmeriCredit repo debt on one’s credit report keeps many, including our new client, from being able to buy or refinance homes or obtain reasonable credit. The lawsuit alleges that AmeriCredit does not follow the legal requirements to go after consumers for money after already repossessing their family car. In short, AmeriCredit fails to provide the required opportunity for families to get their car back so they can stay at work, take their kids to school, and shop for food. Instead, AmeriCredit creates hidden roadblocks and other delays.
